PRIVACY POLICIES

In accordance with the provisions of the Federal Law on Protection of Personal Data held by Private Parties (the “Law”), and in compliance with the obligation of Xtra Inmuebles, S.A. de C.V. (“Isaaya Hotel Boutique”) consisting of protecting the personal data of their clients, affiliates and/or beneficiaries of any of the products, services or memberships belonging to “Isaaya Hotel Boutique” we make of your knowledge the following:

RESPONSIBLE OF THE PERSONAL DATA.

For the effects of the present Privacy Notice, the legal entity responsible of collecting your Personal Data, is the legal entity named Inmobiliaria Cerro Gordo, S.A. de C.V., who will be in charge of the treatment of the personal data which is the obtainment, disclosure, storage, use, including any access action, handling, exploitation, transfer or availability of personal data (the “Treatment”).

For purposes of the provisions of Section I of Article 16 of the Law, the address of “Isaaya Hotel Boutique” is Paseo de la Reforma Number 215, Colonia Lomas de Chapultepec, Delegación Miguel Hidalgo, C.P. 11000, Mexico City.

INFORMATION TO BE COLLECTED.

We inform you that “Isaaya Hotel Boutique” may collect information through different sources, among them:

  1. Personally: When you request or acquire any of the services provided.
  2. Direct: When you provide us with your personal data to request our services or hire them.
  3. Indirect: From any other source of commercially available information or that is permitted by the Law.

For purposes of the present Privacy Notice, including but not limited to, it will be understood as “Personal Data”

General data: Name, sex, address, telephone numbers (home, office and cell phone), email, age, date of birth, personal references, occupation, nationality, country of birth, marital status, Unique Population Registry Code, Federal Taxpayer Registry, name of the company where you have worked, position, seniority in the company, source of income, net monthly income, Social Security Number, education, economic dependents, spouse data, education, sector, type of contract, activity/business, position/occupation, work address in Mexico and the data and information that according to the Law concern to an identified or identifiable natural person

Social networks: In social networks (such as Facebook®, Twitter®, YouTube®, Linkedin® and/or other social networks that may arise), the information provided inside such networks in which “Isaaya Hotel Boutique” participates as a user, do not constitute or is part of the Personal Data subject to the protection of the Privacy Notice, being the responsibility of the company that provides this platform and who publishes it.  

Call Center services or telephone sales: In the cases in which you acquire a product or service of “Isaaya Hotel Boutique” through the telephone operation services that for this purpose is made available to you, it may be possible to require some personal data by telephone, which will be treated in accordance to this privacy notice, we inform you that for your safety and for compliance with the applicable Legislation, “Isaaya Hotel Boutique” may record your calls or conversations through means that may deem appropriate.

Video surveillance: For safety reasons “Isaaya Hotel Boutique” may be able to install video surveillance equipment in all and/or in some of its establishments, so it may be able to collect images, photographs, videos, voices and/or sounds that identify or make identifiable our clients and/or any individual who is inside or transits in and/or through the facilities of “Isaaya Hotel Boutique“.

OPTIONS AND MEANS THAT THE ISAAYA HOTEL BOUTIQUE, OFFERS TO THE OWNERS OF PERSONAL DATA TO LIMIT THE USE OR DISCLOSURE OF THEIR INFORMATION.

The personal data of the owner will be kept in strict confidentiality, in accordance with the security, administrative, technical and physical measures that the “Isaaya Hotel Boutique” implements in its security policies and procedures, being prohibited its illicit disclosure and limiting its use to third parties, in accordance with the provisions of this Privacy Notice.

MEANS FOR THE EXERCISE OF RIGHTS OF THE OWNER.

The owner of personal data may exercise their rights of denial, access, revocation, rectification, cancellation and opposition, by email to [email protected] containing the following information:

  1. The full name of the owner of the personal data, address and email account, to be able to communicate the response to your request.
  2. The documents that prove the identity and, where appropriate, the legal representation of the owner of the personal data.
  3. The clear and precise description of the personal data regarding to which the owner seeks to exercise any of the aforementioned rights.
  4. Any other element or document that facilitates the location of personal data.

For the purposes that gave rise and are necessary for the relationship, it will be understood that, in case of requesting the right of denial, the Owner accepts that he will not be able to hire some of the products or services provided by “Isaaya Hotel Boutique“.

 

TRANSFER OF PERSONAL DATA.

“Isaaya Hotel Boutique” may perform the transfer of data to:

 

  1. The affiliated and subsidiary companies.
  2. Third party service providers for compliance with the legal obligations acquired by “Isaaya Hotel Boutique” or by any of the affiliated and subsidiary companies.
  3. Third party providers of research services, data analysis, submission of information focused on the needs of the owner of personal data, as well as performing other services needed or required by the owner of the personal data.

The third parties and the personal data receiving entities, assume the same obligations and/or responsibilities of “Isaaya Hotel Boutique“, in accordance with what is described in this Privacy Notice.

The owner of the personal data who presents any request or acquires any service or relationship with “Isaaya Hotel Boutique“, accepts the transfer of their personal data, in the terms described in this Privacy Notice.

CHANGES TO THE PRIVACY NOTICE.

Any change to this privacy notice will be informed to you through any of the following means:
